Terms of Service

These Terms of Service ("Terms") govern your access to and use of MisarReach (the "Service"), operated by Misar AI Technology Pvt Ltd ("Misar AI", "we", "us"). By using the Service you agree to these Terms. If you are using it on behalf of an organization, you represent that you are authorized to bind it.
1. The Service
MisarReach provides lead finding and enrichment, multi-channel outreach, and CRM features. We may update, add, or remove features over time. Email is delivered through MisarMail, and some features depend on third-party providers and channels you connect.
2. Accounts
You access the Service through Misar ID single sign-on. You are responsible for activity under your account and for keeping your credentials secure. You must provide accurate information and be at least the age of majority in your jurisdiction.
3. Acceptable use
You agree not to use the Service to:
- send unlawful, deceptive, or unsolicited messages, or otherwise violate anti-spam laws (e.g. CAN-SPAM, DPDP, GDPR/ePrivacy) or platform terms;
- contact individuals without a valid lawful basis, or ignore opt-out and suppression requests;
- scrape, harvest, or process data in violation of any third party's rights or terms;
- transmit malware, attempt to breach security, or disrupt the Service; or
- resell or misrepresent the Service.
You are solely responsible for the content of your outreach and for compliance with all laws applicable to your campaigns.
4. Billing, wallet, and credits
The Service uses a shared Credits Wallet across MisarReach and MisarMail (1 credit = 1 USD). Paid features deduct credits or require an active subscription. Top-ups and subscriptions are billed through our payment processor. Except where required by law, fees and credit purchases are non-refundable. Plan limits, rates, and quotas may change with notice.
5. Third-party channels and providers
Channels such as LinkedIn, SMS/WhatsApp (via your own Twilio), and social networks operate under their own terms and your own accounts. We are not responsible for those services, their availability, or any action they take (including rate limits or account restrictions). You are responsible for complying with each provider's terms.
6. Your data and responsibilities
You retain ownership of the lead, contact, and campaign data you provide or generate. You grant us the rights needed to operate the Service for you. You are the data fiduciary/controller for that data and are responsible for establishing a lawful basis to contact the individuals in it. Our handling of personal data is described in our Privacy Policy.
7. Intellectual property
The Service, including its software, design, and content (excluding your data), is owned by Misar AI and its licensors and is protected by law. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service.
8. Disclaimers
The Service is provided "as is" without warranties of any kind to the maximum extent permitted by law. We do not warrant that lead data is accurate or complete, that outreach will be delivered, or that the Service will be uninterrupted or error-free.
9. Limitation of liability
To the maximum extent permitted by law, Misar AI will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits or data. Our total liability for any claim is limited to the amounts you paid for the Service in the three months before the event giving rise to the claim.
10. Termination
You may stop using the Service at any time. We may suspend or terminate access if you breach these Terms or to protect the Service or other users. On termination, your right to use the Service ends; certain provisions survive, and data is handled per our Privacy Policy.
11. Governing law
These Terms are governed by the laws of India, and disputes are subject to the courts of competent jurisdiction in India, without regard to conflict-of-laws rules.
12. Changes
We may update these Terms and will revise the "Last updated" date above. Material changes will be communicated through the Service; continued use after changes take effect constitutes acceptance.
